2. You are responsible for any activity that occurs under your screen name.

3. You are responsible for keeping your password secure.

4. You may not use The Application for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.

5. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and publish with The Application.

6. You must not modify, adapt or hack The Application or modify another website so as to falsely imply that it is associated with The Appliction.

7. You must not use The Application to create or publish unwanted email ("Spam")

8. You must not use The Application to transmit any worms or viruses or any code of a destructive nature.

9. You must not use The Application to violate any laws in your jurisdiction (including but not limited to copyright laws).

10. Violation of any of these agreements will result in the termination of your account. While The Application prohibits such conduct and content on its site, you understand and agree that The owners of The Application cannot be responsible for the content posted on its web site and published or presented to the general public.

11. You agree not to, nor permit any third party to reverse engineer, decompile, disassemble or otherwise re-develop The Application. You also agree that you will not modify, adapt, license or sell derivative works based upon The Application or any part thereof.

12. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE OWNERS OR LICENSING COMPANY OF THE APPLICATION, NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (1) THE USE OR THE INABILITY TO USE THE SERVICE; (2) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (4) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (5) ANY OTHER MATTER RELATING TO THE FUNCTIONALITY OF THE APPLICATION.

1. As an account holder you may submit video content ("User Videos") and textual content ("Video Descriptions"). User Videos and User Comments are collectively referred to as "User Submissions."

2. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the The Application and these Terms of Service. We claim no intellectual property rights over the material you upload to the The Application. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your account. This will also remove any text, images, video and other digital content you have stored in The Application.

3. We encourage users to publish their creations to the public domain or consider progressive licensing terms.

4. The Application undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:

a. A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;

b. A description of the copyrighted work claimed to have been infringed;

c. A description of the infringing material and information reasonably sufficient to permit administrators to locate the material;
Your contact information, including your address, telephone number, and email;

d. A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

e. A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.

Billing: The credit card that you provide upon registering as a user will be automatically and immediately billed. All currency references are in U.S. dollars. Please note, payment for the Service is billed on a monthly and is non-refundable.

Cancellation: If you cancel your subscription to The Application, you will no longer have access to any content saved inside your video library. If your credit card is invalid for any reason, your subscription may be cancelled and all the information contained within deleted permanently. We accept no liability for information that is deleted due to an invalid credit card. Your subscription may be terminated for any reason, without limitation, if you have violated or acted inconsistently with the letter or spirit of these Terms Of Service. Any contracts, verbal or written or assumed, will be terminated as well. Paid accounts that are terminated will not be refunded.
